Article 2 – General
Please read these terms and conditions (T&C) carefully before you use this website. Placing an order on this website counts as explicit acceptance of our terms and conditions, which can be accessed at all times through our website.
If these T&C are in conflict with the specific conditions of the product or service, it is the specific circumstances of the product or service which prevail.
We reserve the right to change these terms and conditions at any time and without notice.
If any of these conditions are void or invalid, this condition will be considered as severable, but will not affect the validity and enforceability of the other conditions.
Despite the fact that the website was built with the utmost care, it is still possible that the information provided is incomplete or not fully up-to-date. The entrepreneur is only bound to an obligation of means for the correctness, completeness and keeping the information provided up-to-date. The entrepreneur is in no way liable in case of errors, typesetting or printing errors.
When the consumer has specific questions about sizes, color, availability, delivery time or delivery method, the entrepreneur requests the consumer to contact him in advance. Changes to proposed products are possible.
Article 3 – The Order / Agreement
These general Terms and Conditions apply to every type of relationship between TEA-Energy NV and you, the consumer, regardless of whether you are a professional user or a (private) user. By private user we mean every natural person who acts for purposes that are not part of his trade, business, craft or profession.
When you order online on this website as well as for any form of interaction with us for information related to our products and/or services, we will use an electronic communication platform and therefore you accept that all communications, information, agreements, disclaimers and other communications that we exchange with each other, comply with legal requirements. All communications or statements must be made in writing. You agree that such electronic communication are provided via the web. You also agree to receive invoices electronically.
When you place an order on our website, this order is only valid after payment.
TEA-Energy NV reserves the right to refuse orders, without any justification, to change the delivery times, to distribute the deliveries or to link other conditions to the delivery.
When you place items in your shopping cart and pay, you receive all necessary information. This information includes the order details, the product (s) and / or service (s) to be delivered, the price and the possible additional costs, the total price, the payment and delivery proposal.
You will then be asked to read and accept our privacy policy and our terms and conditions.
By clicking on "Pay now" you commit to purchase the chosen product (s) and / or service (s) listed in your order. Immediately after sending your order, you will receive an email confirming your order. We encourage you to print or save this email. We will inform you as soon as possible if one of the products and / or services ordered by you is not available and we will work out a solution together with you.
Spam/junk: If you do not immediately receive a confirmation email from us, first check your spam folder. If you still do not find the confirmation email, send us an email so that we can check the spelling.
The order/agreement has been drawn up in English. The order/agreement takes effect after receipt of our confirmation email stating the order details, the product (s) and / or service (s) to be delivered, the price and possible additional costs, the total price, the payment arrangements and the time of delivery. All prices are in euros and include VAT, unless stated otherwise in the order confirmation. Any shipment and packaging costs are not included in the price unless otherwise stated.
The legally payable VAT is determined on the basis of the place of delivery of products or services, or by the relevant statutory rules.
Article 4 – Price
The prices are specified and payable in Euro. The indication of price only refers to the articles as described on our website. The accompanying photo is decorative and may contain elements or items that are not included in the price.
For all orders the prices applicable on the day of order will be charged. Once ordered, the price is no longer adjusted. The prices indicated for the items are inclusive of VAT, and excluding shipping costs. Any shipping costs are always shown to the customer prior to confirmation before confirming the order.
TEA-Energy NV is not liable for (printing) errors that occur in its offers. If a price is incorrectly stated on a website of the entrepreneur and this was communicated to the consumer, the customer only has the right to cancel the order or to have the order executed at the right price.
Price increases from 3 months after the conclusion of the order/agreement are only permitted if TEA-Energy NV has stipulated this and:
• these are the result of statutory regulations or provisions
• are due to fluctuations on the financial market
The consumer has the authority to cancel the agreement by the day on which the price increase takes effect.
Article 5 – Payment
You can only pay for your online order via the payment module on our website.
You have the choice between different payment methods, as indicated on the payment module. In case of a wire transfer, the entrepreneur reserves the right to cancel the order if no actual payment is made within 7 working days after the order has been placed.
An order concerning a purchase via our website will only be delivered after receiving the full payment.
The consumer cannot assert any rights regarding the execution of the order or service (s), before the stipulated advance payment has taken place.
The consumer has the duty to report any inaccuracy related to the payment details.
Article 6 – Delivery
The delivery will take place at the address that the consumer has written on the website.
Unless agreed otherwise, the delivery times are only indicative and without guarantee because they are dependent on external partners of TEA-Energy NV (transport companies) and on the availability of the ordered products.
If we are unable to fulfill our obligation to deliver the products within the agreed time frame, you can choose one of the following options:
• accept that the products will be delivered within an additional delivery term set by us
• you accept a replacement item that TEA-Energy NV will offer you in a clear way
• you ask us to cancel your order/agreement (except in case of force majeure).
You have the right to cancel the order/agreement immediately, if the delivery within the originally agreed term or on a specific date was vital for you; in this case we have to take into account all the circumstances that applied at the acceptance of this order/agreement. After the cancellation of the order/agreement, we will refund any amounts that were paid for this order/agreement.
TEA-Energy NV cannot be held liable for the full or partial non-fulfillment of its obligations under this agreement when the non-compliance is due to a force majeure event, like a total or partial strike or other work interruptions of the transport & logistic sector and / or general telecommunication / networks /connections issues, unavailability of our website at any time as well as flooding and fire and terrorist acts. If an event classified as force majeure occurs, TEA-Energy NV will inform the consumer. After one (1) month of interruption due to force majeure TEA-Energy NV has the possibility to cancel the order.
The transport carrier makes a maximum of 2 delivery attempts. An email with the delivery date is sent by the delivery courier. Read this email carefully. If the delivery courier could not have delivered within two attempts and if you do not pick up the order within 14 days from one of the pickup points in your area, the order will return to our logistics center and the new delivery will be charged.
Article 7 – Technical installation
Most of our products are designed to be installed by yourself.
If a technical installation of the product is required, this is stated on the product page.
If required, payable and on your request, we can send you a technician (depending on the availability of our technicians).
The installation of our specific products can be carried out by:
• a technician appointed by TEA-Energy NV
• any other technician you have chosen
The technician is responsible for the quality of the technical installation. We are not interfering in the relationship between you and the technician and are therefore not liable if you and / or the technician does not comply with the technical specifications of the product and / or the applicable rules for the installation. We are not responsible and have no liability when direct or indirect damage is caused to you, third parties and / or their property, goods and assets of any kind, unless the technical installation is carried out by a technician of TEA-Energy NV.
Article 8 – Right of Withdrawal
You have 14 days to revoke your order/agreement without stating reasons and without paying any fees or costs, except for the cost of returning the product (s), which is on you. This period starts on the day of the receipt of the product by or on behalf of the consumer.
During this period of 14 days, you, (the consumer) need to handle the product(s) and packaging carefully. You can only unpack or use the product(s) to the extent that this is necessary to assess whether you wish to keep the product(s). If you make use of your right for returns, you will return the product(s) with all delivered accessories, promos, instructions and invoices and in the original condition and packaging to us, in accordance with the instructions provided by us (TEA-Energy NV).
When you wish to return product(s) bought on our website, you must contact TEA-Energy NV within 14 days of delivery by sending an email to service@qaledo.com with the subject 'Withdrawal product'. You will have to return the goods to TEA-Energy NV within 20 days from the delivery of the goods (at your own expense and risk) to the address:

You will receive every payment we have got from you for the purchased product (s) within 14 days of receipt of the returned product (s). You can be held liable if the returned product (s) are reduced in value as a result of the handling of the product (s) (with the exception of treatment in connection with the operation of the product (s)). The value of the product (s) may decrease when the product (s) is / are incomplete or damaged.
The withdrawal period ends 14 days after the day on which you, or a third party appointed by you, different from the carrier, have acquired the physical ownership of the product (s).
Revocation due to incorrect delivery: when TEA-Energy NV has made a mistake in the delivery, you obviously do not have to incur any additional shipping costs in order to exchange the products. Please contact us by email to service@qaledo.com (with the subject: 'Return due to incorrect delivery' + invoice number). Do not send the lamps on your own, but please use only the TEA-Energy NV return label that TEA-Energy NV will deliver to you along with the correct products.
Article 9 – Warranty
TEA-Energy NV does its best so that the products and / or services comply with the order/agreement and the conditions existing at the date of the conclusion of the order/agreement, with legal provisions and / or government regulations.
You will receive a guarantee for every defect that is present at the time of delivery of the product, if you were not aware of whether you could not be expected to be aware of the defect at the time of delivery and if the defect is detected during the warranty period (see below).
The warranty period is 24 months from the moment that you or a third party acting on your behalf acquires the physical ownership of the product you have ordered. For some products the warranty period may be longer and this is mentioned on the page with the product information and on your order.
Always read the labels, warnings, product specifications and guidelines provided with the product or service before using the product or service. In most cases and with the appropriate care, you will extend the life of the acquired product(s).
Our products are manufactured with the maximum care, but like any electronic products, there is a slight chance that they break down. Defective products will be repaired, exchanged or paid back (at the free choice of TEA-Energy N.V.) if the defects are a result of a product failure and not due a result of inappropriate usage like unprofessional installation, installation in humid areas, etc.
Defects or other damage resulting from negligence or improper use or treatment, changes in or to the article made by third parties, either electrically or mechanically for example (but not limited to) drilling extra holes, removing part of the product, etc ), improper installation - if not performed by us - or the use of unsuitable accessories (eg: the lighting flickers because it is used with a non-LED dimmer or with an unmodified transformer), are not covered by the warranty.
The buyer is responsible for the installation of the products and the buyer should make sure that the products are installed by qualified professionals following the product installation instructions when applicable.
The responsibility of TEA-Energy N.V. for any damage created as a result of defective or malfunctioning products procured from TEA-Energy N.V. is limited to the maximum purchase price of the goods as mentioned in the confirmed order/agreement. Any indirect liability which is as a result of defects or malfunctions in our product or it is a result of using our products is explicitly excluded.
You must report the presence of a defect to us as soon as possible from the day on which you discovered the defect. If you return the product within the framework of this 24-month warranty, we will deliver the repaired or replacement product.
We can never be held liable for any damage resulting from the duration of the repair or replacement of the one or more products.
In order to return product(s) under warranty, please follow the following steps:

we will deliver you a replacement product and a return label in the package. With this label you can return the defective products at our expense. Please note: only send them to our express request and with a TEA-Energy NV label. We enjoy a lower rate for returns and do not reimburse the higher costs you might pay for the private shipment!
Please include a copy of the original invoice with the goods.
The liability of TEA-Energy NV, for the damage caused by its fault or negligence in the performance of this agreement or any damage caused by the products sold by TEA-Energy NV, is limited to a maximum of the original purchase price of the agreement. . Any liability of TEA-Energy N.V., for indirect damage or loss of profit, is explicitly excluded.
The warranty only applies to the delivery of the products and not at all to the installation thereof. In other words, TEA-Energy NV will deliver replacement products in accordance with the first delivery. We do not assemble, disassemble or install these products.
Article 10 – Complaints handling
After receipt of the order, the consumer must inspect the delivered goods immediately. Any visible damage and / or qualitative shortcoming of an article or other defect in the delivery must be reported immediately in writing. Complaints submitted to TEA-Energy NV will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, we will respond within the period of 14 days with a notice of receipt and an indication when you can expect a more detailed answer.
If the complaint cannot be resolved by mutual agreement, it will be handled as a dispute and as such, it will request a dispute settlement.
Article 11 – Disputes
Disputes between the entrepreneur and the consumer (based on the general Terms and Conditions) are governed exclusively by Belgian law. Any arbitration will be handled by the Court of Justice of Vilvoorde and the Commercial Court in Brussels.
Article 12 – Identity fraud and / or credit card fraud
In order to guarantee the safety of your online interactions on our website, TEA-Energy NV works exclusively with recognized security partners. Loss or theft of your identity data is kept to a minimum.
TEA-Energy NV believes it has taken all possible and relevant precautions and acts as a careful online intermediary. Any identity theft or financial theft can therefore not be invoked against us.
Article 13 – Privacy and cookies
TEA-Energy NV commits to use the customer's personal data exclusively for the execution of the order/agreement placed on our website and to send the customer information about TEA-Energy NV without any obligation. TEA-Energy NV treats the personal information as confidential information and will never pass on, rent or sell it to third parties.
The website uses cookies. These cookies provide information about your previous visits on the website. We use cookies only to personalize the service proposed to you.
The web pages of the website may contain electronic images or "web banners", counting the number of visitors on the page. Information obtained through these banners is completely anonymous and only makes it possible to collect statistics about visiting frequency in order to provide better service.

Article 14 – Applicable legislation
These Terms and Conditions are governed by the Belgian law and have been prepared accordingly.
If one or more articles of the present Terms and Conditions is considered invalid or declared void by virtue of any legal or administrative action or final decision of a competent court, the remaining articles remain in full force and effect. The invalid stipulation can be replaced by TEA-Energy NV.
